_Pursuant to the Civil Code No. 91/2015/QH13 dated 24 November 2015;_

_Pursuant to the Law on Electronic Transactions No. 20/2023/QH15 dated 22 June 2023;_

_Pursuant to the Law on Cyber Information Security No. 86/2015/QH13 dated 19 November 2015;_

_Pursuant to the Law on Cybersecurity No. 24/2018/QH14 dated 12 June 2018;_

_Pursuant to the Law on Intellectual Property No. 50/2005/QH11 dated 29 November 2005, as amended in 2009, 2019 and 2022;_

_Pursuant to the Law on Children No. 102/2016/QH13 dated 05 April 2016;_

_Pursuant to the Law on Protection of Consumer Rights No. 19/2023/QH15 dated 20 June 2023;_

_Pursuant to Decree No. 13/2023/ND-CP dated 17 April 2023 of the Government on protection of personal data;_

_Pursuant to Decree No. 52/2013/ND-CP dated 16 May 2013 of the Government on e-commerce, as amended by Decree No. 85/2021/ND-CP;_

_Pursuant to Decree No. 147/2024/ND-CP dated 09 November 2024 of the Government on the management, provision and use of Internet services and online information;_

_The Service Provider issues these Terms of Service as follows._

## Chapter I. GENERAL PROVISIONS

**Article 1. Scope and subjects of application**

1. These Terms of Service (the "Terms") govern access to and use of the website donquaan.com together with all subdomains, pages, content, interactive features and related services (collectively, the "Service").
2. These Terms apply to the Service Provider and to every User who accesses or uses the Service, whether or not an account is created.
3. Creation of an account is completed only when the User performs an express, active act of acceptance of these Terms through a click-to-agree mechanism, pursuant to Article 36 of the Law on Electronic Transactions 2023 on the conclusion of electronic contracts. For public parts of the Service that require no account, continued use is deemed acknowledgement and acceptance of these Terms to the extent applicable.
4. These Terms are established and performed in the form of a data message and have legal validity under the Law on Electronic Transactions 2023.

**Article 2. Definitions**

In these Terms, the following terms are understood as follows:

1. "Service Provider" means Mr. Nguyễn Vũ Đông Quân (known as "DonQuaan"), a natural person having full civil legal capacity and full capacity for civil acts under the Civil Code 2015, being the owner and operator of the Service and the Personal Data Controller with respect to data processed through the Service.
2. "User" means an individual who accesses or uses the Service.
3. "Data Subject" means an individual reflected by personal data processed through the Service, as understood under Decree No. 13/2023/ND-CP.
4. "Account" means the registration profile enabling a User to access dedicated features of the Service.
5. "User Content" means any data, text, image, link, comment or other material that a User uploads, submits or transmits through the Service.
6. "Service Provider Content" means any material created or owned by the Service Provider on the Service, including text, images, source code, interface design and databases.
7. "Personal Data" is understood in accordance with Decree No. 13/2023/ND-CP.
8. "Child" means a person under 16 years of age, pursuant to Article 1 of the Law on Children 2016.
9. "Third-Party Platform" means services operated by third parties to which the Service links, including but not limited to Discord and YouTube.

**Article 3. Status of the Service Provider**

1. The Service is a personal website operated by the Service Provider in an individual capacity; it is not the activity of an organisation or juridical person.
2. The Service Provider has full civil legal capacity and full capacity for civil acts to establish and perform the rights and obligations arising from these Terms.
3. All contact with the Service Provider is made through the email address: [contact@donquaan.com](mailto:contact@donquaan.com).

## Chapter II. CONDITIONS OF USE AND ACCOUNTS

**Article 4. Age and conditions of use**

1. The minimum age to register an account and use the interactive features of the Service is 13 years. Persons under 13 are not permitted to register an account.
2. For Users under 16 years of age, personal data is processed only with the verified consent of a parent or legal guardian; for a person from 7 to under 16 years of age, the consent of both that person and the parent or legal guardian is required, pursuant to Article 20 of Decree No. 13/2023/ND-CP and the Law on Children 2016. Detailed protective measures are set out in the Age, Eligibility and Cooperation Terms.
3. Certain elevated actions, including formal partnership contact, apply only to persons aged 16 or older.
4. When accessing a Third-Party Platform through a link on the Service, the User must also meet the separate age conditions of that platform.

**Article 5. Registration and account security**

1. The User provides accurate and complete information upon registration and updates it upon change.
2. The User is responsible for keeping login credentials confidential and for all activity under the User's account.
3. The User promptly notifies the Service Provider upon discovering unauthorised access or a security breach relating to the account.
4. The Service Provider applies reasonable technical and organisational measures to protect accounts and data, consistent with the Law on Cyber Information Security 2015 and Decree No. 13/2023/ND-CP; however, no system is perfectly secure.

## Chapter III. WHAT THE USER MAY EXPECT FROM THE SERVICE PROVIDER

**Article 6. Operation and changes to the Service**

1. The Service Provider endeavours to keep the Service stable, secure and continuously improving, but does not warrant that the Service will be uninterrupted or error-free.
2. The Service Provider may add, change, suspend or discontinue part or all of the features of the Service. For material changes, the Service Provider gives notice on the Service within a reasonable time before they take effect, except where immediate action is required for safety or legal reasons.
3. The Service Provider is transparent about the collection and use of personal data under the Privacy Policy and the Cookie Policy, and does not force blanket acceptance of non-essential data processing.

**Article 7. Support and contact**

1. The standard contact channel is the email address [contact@donquaan.com](mailto:contact@donquaan.com); the Service Provider handles standard contacts on a reasonable-efforts basis, with no commitment as to time.
2. Priority support and cooperation privileges are governed separately by the Age, Eligibility and Cooperation Terms and arise only under a separate agreement.

## Chapter IV. CONTENT AND INTELLECTUAL PROPERTY

**Article 8. User Content**

1. The User retains ownership of the User Content the User creates.
2. When uploading User Content to the Service, the User grants the Service Provider a limited, non-exclusive, royalty-free right to use it to the extent necessary to store, display and operate that content on the Service. This right ends when the User deletes the content, except for temporary technical copies and copies others may have saved.
3. The moral rights of the author under the Law on Intellectual Property are reserved to the User.
4. The User represents that the User holds sufficient rights to the User Content and that uploading it does not infringe the rights of any third party.

**Article 9. Service Provider Content and intellectual property**

1. All Service Provider Content is protected under the Law on Intellectual Property 2005 (as amended) and the international treaties to which Vietnam is a party.
2. Copying, distributing, modifying, creating derivative works from, or otherwise exploiting Service Provider Content without written consent is prohibited, except as permitted by law.
3. Automated data collection, systematic reproduction or extraction of the Service's database without permission is prohibited.

**Article 10. Notice and takedown of copyright-infringing content**

1. A rights holder who believes that content on the Service infringes its rights sends a written notice to [contact@donquaan.com](mailto:contact@donquaan.com), including information about the content complained of, the basis of the right, and contact details.
2. The Service Provider reviews a valid notice and, where appropriate, removes or disables access to the content complained of within a reasonable time.
3. A person whose content is removed may submit a written objection under Article 24 of these Terms. Handling is carried out in accordance with Vietnamese law on intellectual property and consistent with relevant international treaties.

## Chapter V. RESTRICTED CONDUCT WHEN USING THE SERVICE

**Article 11. Principles of use**

1. The User uses the Service for its proper purpose, in compliance with the law of Vietnam and these Terms.
2. Detailed rules on content and conduct are set out in the Acceptable Use Policy, which forms an integral part of these Terms.

**Article 12. Prohibited conduct**

The User must not, when using the Service:

1. Upload or transmit content that violates the law of Vietnam, including content that harms national security, incites violence, is obscene, abuses children, defames, or offends the honour, dignity or reputation of others.
2. Infringe intellectual property rights or other lawful rights of third parties.
3. Unlawfully collect or process the personal data of others, in breach of Decree No. 13/2023/ND-CP.
4. Distribute malware, or carry out attacks, scanning, or unauthorised interference with the Service or related systems.
5. Impersonate, defraud, distribute spam, or engage in fraudulent conduct.
6. Use automated means to access, copy or extract the Service's data without authorisation.
7. Other conduct prohibited under the Law on Cybersecurity 2018 and Decree No. 147/2024/ND-CP.

**Article 13. Handling of violations**

1. Upon detecting a violation, the Service Provider applies a measure proportionate to the nature and seriousness of the violation, on a graduated scale: warning; restriction of features; removal of content; suspension of the account; termination of the account.
2. For serious violations, in particular those concerning child safety, credible threats of violence, or attacks on system security, the Service Provider may immediately apply removal and termination without following the graduated steps.
3. A User subject to a handling measure may appeal under Article 24 of these Terms.

## Chapter VI. PERSONAL DATA AND CONSENT

**Article 14. Protection of personal data**

1. The collection and processing of personal data is carried out under the Privacy Policy and the Cookie Policy, in compliance with Decree No. 13/2023/ND-CP.
2. Acceptance of these Terms does not amount to consent to non-essential data processing such as analytics and advertising; such consents are obtained separately, per purpose, and may be withdrawn at any time.

**Article 15. Consent mechanism and record-keeping**

1. Consent to conclude the electronic contract and consent to process personal data are obtained through an affirmative, active act of the Data Subject, pursuant to Article 11 of Decree No. 13/2023/ND-CP and Article 36 of the Law on Electronic Transactions 2023.
2. The Service Provider keeps a record of consent to serve the burden of proof, including the subject's identifier, the time, the technical characteristics of the accessing device, the version of the document consented to, and the consent status for each purpose.
3. The Data Subject has the right to withdraw consent and to request deletion of data through account functions or through [contact@donquaan.com](mailto:contact@donquaan.com), consistent with statutory retention periods.

## Chapter VII. FEES AND COSTS

**Article 16. Fees for using the Service**

1. Access to and use of the basic features of the Service is free of charge, unless otherwise clearly announced.

**Article 17. Data and telecommunications charges**

The User is responsible for paying any mobile telecommunications charges that may be incurred when using the Service, including data charges and messaging charges, such as SMS, MMS or other messaging protocols or technologies. If the User is uncertain about the charges that may apply, the User should contact the User's mobile service provider before using the Service.

## Chapter VIII. TERM AND TERMINATION

**Article 18. Term**

These Terms take effect from the time the User accepts them and remain in effect throughout the period the User accesses or uses the Service.

**Article 19. Termination by the User**

The User may stop using the Service and request deletion of the account at any time through account functions or through [contact@donquaan.com](mailto:contact@donquaan.com).

**Article 20. Suspension and termination by the Service Provider**

1. The Service Provider may suspend or terminate a User's access upon a violation of these Terms or the law, in accordance with Article 13.
2. Except for serious violations or where the law requires otherwise, the Service Provider gives prior notice within a reasonable time.

**Article 21. Effects of termination**

1. Upon termination, the User's access to the account and dedicated features ceases.
2. Personal data is processed after termination in accordance with the Privacy Policy and statutory retention periods.
3. Provisions on intellectual property, limitation of liability, and dispute resolution continue in effect after termination.

## Chapter IX. COMPLAINTS, APPEALS AND DISPUTE RESOLUTION

**Article 22. Receipt of complaints**

1. The User may complain about the provision of the Service or the processing of personal data through [contact@donquaan.com](mailto:contact@donquaan.com).
2. The Service Provider receives and responds to a valid complaint within a reasonable time.

**Article 23. Consumer rights**

Where the User is a consumer, the User's rights under the Law on Protection of Consumer Rights 2023 are respected and are not unlawfully restricted by these Terms.

**Article 24. Appeal against handling measures**

1. A User subject to a restriction, content removal, suspension or termination of an account may submit a written appeal to [contact@donquaan.com](mailto:contact@donquaan.com), stating the reasons and providing supporting materials.
2. The Service Provider reviews the matter objectively and notifies the outcome of the appeal within a reasonable time.

**Article 25. Governing law and dispute resolution**

1. These Terms are governed by and construed in accordance with the law of the Socialist Republic of Vietnam.
2. Disputes are first resolved through negotiation and conciliation; where no agreement is reached, disputes are submitted to the competent Court of Vietnam for resolution.

## Chapter X. LIMITATION OF LIABILITY

**Article 26. Service provided on an "as is" basis**

The Service is provided on an "as is" and "as available" basis. The Service Provider does not warrant that the Service will meet every requirement of the User or be uninterrupted or error-free.

**Article 27. Limitation of liability**

1. To the extent permitted by law, the Service Provider is liable only for actual, direct damage arising from its fault.
2. The Service Provider does not exclude or limit liability for obligations that the law does not permit to be excluded, including liability for intentionally caused damage or damage to life or health under the Civil Code 2015.

**Article 28. The User's compensation obligation**

The User is responsible for compensating damage arising from a violation of these Terms or the law, including damage caused by User Content or by unauthorised use of the Service, in accordance with the Civil Code 2015.

## Chapter XI. IMPLEMENTATION PROVISIONS

**Article 29. Related documents**

The Privacy Policy, the Cookie Policy, the Acceptable Use Policy, the Age, Eligibility and Cooperation Terms, and the Third-Party Platforms Terms are integral parts of, and are incorporated by reference into, these Terms. These documents are available at donquaan.com/rules-and-policies.

**Article 30. Amendment and version management**

1. The Service Provider may amend these Terms; the version and effective date are updated at the top of the document.
2. For material changes that expand non-essential data processing, the Service Provider obtains renewed consent per purpose rather than treating prior consent as automatically covering the new purpose.
3. Superseded versions are archived for reference; the User may request a copy through [contact@donquaan.com](mailto:contact@donquaan.com).

**Article 31. Severability**

Where a provision is determined to be invalid or unenforceable, the remaining provisions remain in full effect.

**Article 32. Transitional and assignment provisions**

The User may not assign rights or obligations under these Terms without the Service Provider's consent. The Service Provider may assign its rights and obligations, including where the Service is later operated through a newly formed juridical person, provided that the User's rights under the law are not diminished; such change is notified through the version-management mechanism in Article 30.
