GENERAL PROVISIONS **Article 1. Scope and how to read this document** 1. The website donquaan.com links directly to one Discord server and one YouTube channel operated by the Service Provider. Because the Service Provider actively invites the User to those two platforms, this document sets out, in plain language, how the rules of those platforms relate to the rules of the Service Provider. 2. This document does not cover any other third-party platform; a general disclaimer for other external links is set out in the Terms of Service. 3. In this document, "Service Provider" means Mr. Nguyễn Vũ Đông Quân (known as "DonQuaan"), a natural person having full civil legal capacity and full capacity for civil acts under the Civil Code 2015, being the owner and operator of the website donquaan.com and the Personal Data Controller with respect to data processed through the website; "User" means an individual who accesses or uses the website and the platforms named above through the website's links. **Article 2. Status of the summary and order of precedence** 1. Any content in this document marked as the Service Provider's summary is expressed in the Service Provider's own words, for reading convenience only. That summary is not a copy of, and does not replace, the official Discord or YouTube documents. 2. Only the official versions published by Discord Inc. and by Google LLC / YouTube are binding. Where the Service Provider's summary differs from the official text of those platforms, the platforms' official text controls. 3. The Service Provider deliberately does not reproduce Discord's or YouTube's Terms of Service or Community Guidelines word-for-word. Those texts are intellectual property protected by copyright of Discord Inc. and Google LLC respectively, under the Law on Intellectual Property 2005 and the WIPO Copyright Treaty, and each platform restricts copying of its terms. The Service Provider links to the official sources so that the User can read the authoritative wording directly. **Article 3. Governing law and protection of personal data** 1. The law of Vietnam governs this document. 2. Where Discord Inc. or Google LLC processes the User's personal data because the User followed the Service Provider's link to their platform, Decree No. 13/2023/ND-CP on protection of personal data may apply to that processing, together with those platforms' own privacy policies. For visitors from the European Union or the European Economic Area, the General Data Protection Regulation of the European Union (Regulation (EU) 2016/679) may apply to the processing carried out by the platforms. **Article 4. Version management** This version reflects the two platforms' terms as reviewed by the Service Provider on 08/07/2026. Platform terms change frequently; if they change materially, the Service Provider bumps the version of this document; the review note is set out in Chapter IV. **Article 5. No affiliation, no sponsorship** "Discord" and "YouTube" are trademarks of their respective owners. The website donquaan.com is not affiliated with, endorsed by, or sponsored by Discord Inc. or Google LLC. The Service Provider uses their names and marks only to identify the platforms to which the website links, by way of nominative reference. --- ## Chapter II. DISCORD **Article 6. Basis of this Chapter** The website donquaan.com links directly to the Service Provider's Discord server. When the User follows that link and joins, the User enters a service operated by Discord Inc., not by the Service Provider. Discord has its own binding rules. The Service Provider restates those rules here briefly, out of respect for those rules and to ensure the User knows they apply the moment the User uses Discord; but the Service Provider does not, and cannot, override them. **Article 7. Incorporation of Discord's rules by reference** 1. In plain terms: by using Discord, the User agrees directly to Discord's own rules, and nothing in this document changes that. 2. When the User accesses or uses the Service Provider's Discord server, the User is directly bound by Discord's own Terms of Service, Community Guidelines, Privacy Policy and other Discord policies, independently of the Service Provider's terms. 3. The Service Provider does not replace, amend, waive or nullify Discord's terms; the Service Provider merely restates and respects them. The User must comply simultaneously with both the Service Provider's rules, being its Terms of Service and Acceptable Use Policy, and Discord's rules. Discord's official documents are the only binding versions. **Article 8. Summary of Discord's key points** 1. The content of this Article is the Service Provider's summary, for reading convenience only; the official Discord version is the one that has legal effect. The summary is based on the Discord Terms of Service effective 29/09/2025 and the Discord Community Guidelines, as reviewed by the Service Provider on 08/07/2026. Discord may change those documents at any time; the User should always check the official links in Article 11. 2. Minimum age: the User must be at least 13 years old to use Discord, and must meet any higher minimum age required by the law of the User's country. A parent or legal guardian is responsible for a permitted minor's account activity. Some spaces with age-restricted or adult content are limited to users aged 18 or older. The minimum age of donquaan.com itself is set out in Article 10. 3. Core prohibited conduct, in the Service Provider's own words, includes: a) No child-sexual-exploitation content; such content is strictly forbidden everywhere, with zero tolerance; b) No violent extremism or terrorism; c) No harassment, threats, or disclosure of others' personal information; d) No hateful conduct targeting protected characteristics; đ) No content that promotes or normalises suicide or self-harm; e) No gore or graphic violence used to shock or harass; g) No spam or spam tooling, including raid tools, token generators, tools that defeat verification challenges, and similar tools; h) No scams, phishing, distribution of malware, or attacks on Discord's systems; i) No identity misrepresentation or impersonation; k) No ban evasion; l) No other illegal activity. 1. Content and licence, in the Service Provider's own words: the User keeps ownership of what the User posts, but grants Discord a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to use, reproduce, distribute, create derivative works of, display and perform the User's content in order to operate and improve the service. Separately, Discord's Terms include a survival section under which certain provisions — for example, retention or display of some data, outstanding payment obligations, indemnities, disclaimers, liability limits, and dispute-resolution terms — continue to apply even after the User deletes the account. 2. Termination and enforcement: Discord may suspend or terminate accounts, with or without notice, for violations, for legal or safety reasons, or for extended inactivity, which Discord states is around two years. Discord's Trust and Safety team may warn, remove content, suspend, permanently ban accounts or servers, and report to law enforcement. Discord makes an appeals process available, with specific windows for some regions. 3. Age-assurance changes in progress: Discord is rolling out a global teen-by-default experience with age assurance and verification, expected in the second half of 2026; a March 2026 rollout was delayed after user feedback. This change may affect how age is checked and the access available to unverified accounts. **Article 9. Enforcement on the Service Provider's server** If the User breaks Discord's rules on the Service Provider's Discord server, the Service Provider may apply measures under its Acceptable Use Policy — for example, warning, muting, kicking, or banning the User from the Service Provider's server — and may report the behaviour to Discord or leave it to be handled by Discord. Discord alone applies its own rules and remedies, including any suspension or ban at the Discord level. The two are independent: the Service Provider's action does not limit Discord's, and Discord's action does not limit the Service Provider's. **Article 10. Age** Discord requires users to be at least 13 years old. The minimum age of donquaan.com itself is also 13, with additional protections for Users under 16 as set out in the Age, Eligibility and Cooperation Terms. The User must therefore meet simultaneously both the Service Provider's 13-or-older requirement and Discord's age requirement, being 13, or any higher local minimum Discord applies in the User's region. **Article 11. Discord's official links and archived backups** 1. The Service Provider displays the summary above as text on its website and does not auto-redirect the User anywhere; the official links open only when the User actively clicks them. 2. The official pages are served according to the User's region and language, and the authoritative version is the one Discord designates. **Article 12. Disclaimer regarding Discord** The Service Provider does not control Discord and is not responsible for the Discord platform, its availability, its moderation decisions, or any changes to its terms. Discord's terms and policies can change at any time without notice to the Service Provider. The User's relationship with Discord is directly between the User and Discord Inc. --- ## Chapter III. YOUTUBE **Article 13. Basis of this Chapter** The website donquaan.com links directly to the Service Provider's YouTube channel. When the User follows that link and watches, comments, or otherwise uses YouTube, the User uses a service operated by Google LLC / YouTube, not by the Service Provider. YouTube has its own binding rules. The Service Provider restates those rules here briefly, out of respect for those rules and to ensure the User knows they apply; but the Service Provider does not, and cannot, override them. **Article 14. Incorporation of YouTube's rules by reference** 1. In plain terms: by using YouTube, the User agrees directly to YouTube's own rules, and nothing in this document changes that. 2. When the User accesses or uses the Service Provider's YouTube channel, or any YouTube feature via the Service Provider's links, the User is directly bound by YouTube's own Terms of Service, Community Guidelines, Privacy Policy and other YouTube / Google policies, independently of the Service Provider's terms. 3. The Service Provider does not replace, amend, waive or nullify YouTube's terms; the Service Provider merely restates and respects them. The User must comply simultaneously with both the Service Provider's rules and YouTube's rules. YouTube's official documents are the only binding versions. **Article 15. Summary of YouTube's key points** 1. The content of this Article is the Service Provider's summary, for reading convenience only; the official YouTube version is the one that has legal effect. The summary is based on the YouTube Terms of Service and the current YouTube Community Guidelines, as reviewed by the Service Provider on 08/07/2026. YouTube may change those documents at any time; the User should always check the official links in Article 18. 2. Which Terms and effective date apply to the User: YouTube publishes region-specific Terms of Service, and the effective date and minimum age shown can differ by region; for example, the version the Service Provider reviewed showed an effective date of 05/01/2022, and YouTube states that higher minimum ages apply in some regions. The User reads the version YouTube serves to the User at the official link in Article 18. 3. Minimum age: the User generally must be at least 13 years old to use YouTube on the User's own; a higher minimum applies in some regions; younger children may use it only via a parent or guardian through products such as YouTube Kids where available. The minimum age of donquaan.com itself is set out in Article 17. 4. Content and licence, in the Service Provider's own words: the User keeps ownership of the content the User uploads, but grants YouTube a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to use that content in connection with the service and YouTube's business; and grants other users a limited licence to access the User's content through YouTube's features. This does not permit independent use of the User's content outside YouTube. 5. Core restrictions, in the Service Provider's own words, include: a) Do not circumvent security measures or access limits; b) Do not use unauthorised automated access, including scraping or bots; c) Do not manipulate engagement metrics; d) Do not misuse reporting tools; đ) Do not publicly display or broadcast YouTube content for commercial purposes without authorisation. 1. The main policy areas of the Community Guidelines, mirroring the headings in YouTube's own policy hub, include: spam and deceptive practices; sensitive content, including child safety, nudity or sexual content, and suicide or self-harm; violent or dangerous content, including hate speech, harassment, graphic violence, and violent criminal or extremist organisations; regulated goods; and misinformation. A limited exception exists for content with genuine educational, documentary, scientific or artistic context. The category names follow YouTube's own policy-hub structure; the Service Provider reproduces the headings only to point the User to the appropriate official policy. 2. Enforcement and termination: a first violation is typically a warning; further violations lead to Community Guidelines strikes, and three strikes within a 90-day window can result in channel termination, while a severe violation can bypass the strike system entirely. Each strike lasts 90 days from issuance; a first-time warning can expire after 90 days only if the User completes YouTube's optional policy training, and that 90-day period starts when the training is completed. Deleting the User's content does not remove a strike. YouTube may suspend or terminate access for serious or repeated violations, for legal reasons, or for risk of harm, and the decisions can be appealed. **Article 16. Enforcement on the Service Provider's channel** If the User breaks YouTube's rules on the Service Provider's YouTube channel — for example, in comments — the Service Provider may apply measures under its Acceptable Use Policy, for example removing or blocking the User's comments, and may report the behaviour to YouTube. YouTube alone may apply strikes, remove content, or terminate the channel under its own rules. The two are independent: the Service Provider's action does not limit YouTube's, and YouTube's action does not limit the Service Provider's. **Article 17. Age** YouTube requires users to be at least 13 years old, higher in some regions. The minimum age of donquaan.com itself is also 13, with additional protections for Users under 16 as set out in the Age, Eligibility and Cooperation Terms. The User must meet simultaneously both the Service Provider's 13-or-older requirement and YouTube's age requirement for the User's region. **Article 18. YouTube's official links and archived backups** 1. The Service Provider displays the summary above as text on its website and does not auto-redirect the User anywhere; the official links open only when the User actively clicks them. 2. The Service Provider displays the Google Support policy hub as the primary Community Guidelines link because it is more detailed and stable than the marketing overview page. **Article 19. Disclaimer regarding YouTube** The Service Provider does not control YouTube and is not responsible for the YouTube platform, its availability, its moderation or monetisation decisions, or any changes to its terms. YouTube's terms and policies can change at any time without notice to the Service Provider. The User's relationship with YouTube is directly between the User and Google LLC / YouTube. --- ## Chapter IV. SOURCE-ACCESS TRANSPARENCY AND IMPLEMENTATION PROVISIONS **Article 20. Source-access and transparency note** 1. On 08/07/2026, the Service Provider reviewed the official Discord Terms of Service, effective 29/09/2025, and the Discord Community Guidelines, and the official YouTube Terms of Service, the version served to the Service Provider showing an effective date of 05/01/2022, and the YouTube Community Guidelines policy hub. Because YouTube's high-level overview page carries limited detail, the summary of YouTube's Community Guidelines draws on YouTube's fuller policy-hub page at support.google.com/youtube/answer/9288567. 2. The Service Provider's summaries restate only points the Service Provider could confirm from an official source. The effective dates and minimum ages shown are those the platforms displayed to the Service Provider on the review date, may differ by region, and may have changed since. The archived backup links in Article 11 and Article 18 are provided only as a fallback; the live official pages always take precedence. **Article 21. Relationship with other documents and contact** 1. This document is an integral part of, and is incorporated by reference into, the Terms of Service of donquaan.com, and is read together with the Acceptable Use Policy and the Age, Eligibility and Cooperation Terms. 2.
