## Chapter I. GENERAL PROVISIONS

**Article 1. Scope and subjects of application**

1. This Cookie Policy (the "Policy") explains what cookies and similar technologies are, which ones the website donquaan.com together with all subdomains (collectively, the "Service") uses, for what purposes, who else may receive the data, how long they last, where the data is transferred, and how the User controls them.
2. This Policy applies to the Service Provider and to every User who accesses or uses the Service, whether or not an account is created.
3. This Policy is an integral part of the system of documents governing the Service and is to be read together with the Privacy Policy and the Terms of Service. Where this Policy touches wider topics of personal data, the Privacy Policy is the primary governing document; any limitation of liability applicable to use of the Service is governed by the Terms of Service.

**Article 2. Definitions**

In this Policy, the following terms are understood as follows:

1. "Service Provider" means Mr. Nguyễn Vũ Đông Quân (known as "DonQuaan"), a natural person having full civil legal capacity and full capacity for civil acts under the Civil Code 2015, being the owner and operator of the Service and the Personal Data Controller with respect to data processed through the Service under Decree No. 13/2023/ND-CP.
2. "User" means an individual who accesses or uses the Service.
3. "Data Subject" means an individual reflected by personal data processed through the Service, under Decree No. 13/2023/ND-CP.
4. "Cookie" means a small text file that a website asks the browser to store on the User's device; on the next visit, the browser may send it back, letting the Service recognise the session, remember settings or measure usage.
5. "Similar technologies" means technologies grouped under the word "cookie" in this Policy, including the browser's local storage and session storage, display pixels and tracking scripts, software development kits and tags, and device identifiers or advertising identifiers.
6. "First-party cookie" means a cookie set by donquaan.com itself, or set by infrastructure providers acting on behalf of and on the instructions of the Service Provider, to operate the Service.
7. "Third-party cookie" means a cookie set by outside services embedded in the Service.
8. "Session cookie" means a cookie that expires when the User closes the browser; "persistent cookie" means a cookie that remains for a set period or until the User deletes it.
9. "Child" means a person under 16 years of age, pursuant to Article 1 of the Law on Children 2016.

**Article 3. Status of the Service Provider**

1. The Service is a personal website operated by the Service Provider in an individual capacity; it is not the activity of an organisation or juridical person.
2. The Service Provider acts as the Personal Data Controller with respect to personal data processed through the Service under Decree No. 13/2023/ND-CP.
3. All contact with the Service Provider is made through the email address: [contact@donquaan.com](mailto:contact@donquaan.com).

**Article 4. Governing framework and consent posture**

1. This Policy is drafted to align with the law of Vietnam, in particular Decree No. 13/2023/ND-CP on protection of personal data; for visitors in the European Union and the European Economic Area, this Policy additionally references the General Data Protection Regulation of the European Union.
2. The Service Provider takes a layered consent approach: only strictly necessary cookies run automatically; every other cookie category is opt-in, off by default, and freely refusable.
3. The Service Provider does not condition account creation, log-in, or access to the core features of the Service on the User's acceptance of functional, analytics, or advertising cookies.

## Chapter II. DATA THAT COOKIES HELP COLLECT

**Article 5. Types of data collected via cookies**

Depending on the cookie categories the User enables, cookies and similar technologies may help collect:

1. Basic identifiers the User provides at registration or log-in, namely name, email and phone number, associated with essential or functional cookies that maintain the session.
2. Device and browser information, namely device type, operating system, browser type and version, screen settings and language.
3. Approximate location, namely an approximate region or city derived from the Internet protocol address, not precise satellite positioning.
4. Network and Internet service provider information, namely the Internet service provider and network-level metadata.
5. Behaviour and digital footprint, namely pages viewed, links or buttons clicked, time on page, scroll and interaction, the referring page address, and general navigation patterns.
6. Cookie identifiers or advertising identifiers described in Article 2 of this Policy.

**Article 6. No collection of sensitive personal data via cookies**

1. The Service Provider does not use cookies to collect sensitive personal data as defined under Decree No. 13/2023/ND-CP.
2. The Service Provider does not combine signals about approximate location, network and Internet service provider, and digital footprint to profile or infer sensitive characteristics such as health, beliefs or other sensitive categories.
3. Where a future feature would process sensitive data, that feature requires separate, specific consent and is outside the scope of ordinary cookie consent, under the Privacy Policy.

## Chapter III. COOKIE CATEGORIES

**Article 7. Classification of cookies**

1. The Service Provider sorts every cookie into one of the following four categories:

a) Category 1 — Strictly necessary cookies: always on; the User cannot refuse them because they are necessary to operate the Service; no separate consent is required because they are necessary to provide the service, to secure the service and to meet legal obligations;

b) Category 2 — Functional cookies: off by default; the User may refuse them; consent is required through an opt-in mechanism;

c) Category 3 — Analytics cookies, including Google Analytics 4 and first-party measurement: off by default; the User may refuse them; consent is required through an opt-in mechanism;

d) Category 4 — Advertising and marketing cookies, including the Meta Pixel and advertising identifiers: off by default; the User may refuse them; consent is required through an opt-in mechanism.

1. Analytics activity, including any first-party measurement, is never treated as strictly necessary; it always falls within Category 3 and is opt-in, even where collected on the Service Provider's own infrastructure.

**Article 8. Strictly necessary cookies (Category 1)**

1. Purpose: authentication and session management, keeping the User logged in via Google, email or phone through Supabase; security and abuse and fraud prevention; load-balancing and reliability; remembering the User's cookie-consent choices themselves; cross-site request forgery protection and basic anti-bot protection. This category does not include any traffic measurement or analytics; those activities fall within Category 3 even where collected on the Service Provider's own infrastructure.
2. Illustrative example cookies: session token or authentication cookie of Supabase; consent-state cookie storing the User's choices; Cloudflare security cookies, for example `__cf_bm`, `cf_clearance`, used only for bot management and abuse prevention.
3. Nature: primarily first-party, set by donquaan.com through Supabase and Cloudflare acting as data processors on the Service Provider's instructions.
4. Typical duration: from session to short-lived persistent; the consent cookie persists so re-asking every visit is unnecessary, and the User may clear or change it anytime via "Cookie settings".
5. Recipients of the data: the Service Provider and the infrastructure processors Cloudflare and Supabase, acting on the Service Provider's instructions.
6. Legal basis: under Decree No. 13/2023/ND-CP, the processing is necessary to perform the service the User requests, to keep the Service secure and to comply with legal obligations, not based on consent. The User may block these cookies in the browser, but the Service may not function.

**Article 9. Functional cookies (Category 2)**

1. Purpose: remember non-essential preferences such as language, light or dark theme, interface layout, remember-me conveniences and previously dismissed notices; enable optional embedded content the User interacts with.
2. Illustrative example cookies: `pref_lang`, `theme_mode`, `ui_state` or similar preference cookies; cookies set by optional embedded content the User chooses to load.
3. Nature: mostly first-party; some may be third-party if the User loads optional embedded content, for example an embedded video player.
4. Typical duration: persistent; the exact lifetime is set per the provider's current documentation and the Service Provider's configuration.
5. Recipients of the data: the Service Provider; for optional embeds, the relevant embed provider.
6. Legal basis: the User's consent through an opt-in mechanism. Where the User refuses, the Service will not remember these preferences between visits; nothing else on the Service is affected. The User may withdraw at any time under Article 12 of this Policy.

**Article 10. Analytics cookies (Category 3)**

1. Purpose: measure traffic and audience, namely visits, unique users and sessions; understand navigation and content performance; diagnose errors and improve the Service. This category includes Google Analytics 4 and first-party analytics that the Service Provider operates itself on its own infrastructure.
2. Illustrative example cookies or identifiers:

a) Google Analytics 4: `_ga`, `_ga_<container-id>`, being client or session identifiers;

b) First-party analytics: a first-party visitor or measurement identifier set by donquaan.com.

1. Nature: Google Analytics 4 cookies are third-party cookies set by Google; first-party analytics is a first-party cookie set by donquaan.com. Supabase is not an analytics provider; it handles authentication and backend only.
2. Typical duration: `_ga` and `_ga_<id>` of Google Analytics 4 last up to 2 years by Google's documented default, which may be configured shorter; the first-party analytics identifier lasts a comparable period set in the Service Provider's configuration.
3. Recipients of the data: the Service Provider; for Google Analytics 4, Google, acting as an independent controller and a third-party recipient, not the Service Provider's processor at default configuration, under Articles 11 and 14 of this Policy on cross-border transfer.
4. Legal basis: the User's consent through an opt-in mechanism. Where the User refuses, the Service Provider does not measure the User's visit; the User's access to and use of the Service is completely unaffected. The User may withdraw at any time under Article 12 of this Policy.

**Article 11. Advertising and marketing cookies (Category 4)**

1. Purpose: measure the effectiveness of marketing, understand conversions and enable audience and remarketing features. This category includes the Meta Pixel and associated advertising identifiers.
2. Illustrative example cookies or identifiers:

a) Meta: `_fbp`, written in the first-party cookie context but read by Meta, `fr`, a Meta third-party advertising cookie, and event data sent to Meta;

b) Advertising identifiers and any campaign or click identifiers.

1. Nature: mixed; `_fbp` is written in the first-party context but read by Meta; `fr` and Meta's advertising cookies are Meta third-party cookies.
2. Typical duration: commonly up to about 90 days for `_fbp` and up to about 90 days for `fr`.
3. Recipients of the data: the Service Provider; and Meta Platforms, acting as an independent controller and a third-party recipient, under Articles 11 and 14 of this Policy on cross-border transfer.
4. Legal basis: the User's consent through an opt-in mechanism. Where the User refuses, no advertising or measurement pixels fire and no advertising data is shared with Meta; the User's access to and use of the Service is completely unaffected. The User may withdraw at any time under Article 12 of this Policy.

## Chapter IV. CONSENT MECHANISM AND WITHDRAWAL OF CONSENT

**Article 12. Obtaining, managing and withdrawing consent**

1. On the first visit and when a material change so requires, a cookie banner appears. No non-essential cookies of Category 2 to Category 4 are set before the User makes a choice; these cookies remain off by default. Strictly necessary cookies of Category 1 load because the Service cannot run without them.
2. The banner lets the User accept or reject each category of functional, analytics and advertising cookies separately; for cross-border sharing, the User is informed which recipient and which destination outside the territory of Vietnam each choice enables. The button to reject all non-essential cookies is presented with equal prominence to the button to accept all. The User is never required to accept all in order to continue.
3. Consistent with Decree No. 13/2023/ND-CP, under which consent must be voluntary, specific and per-purpose, the User's consent is freely given. Refusing non-essential cookies does not affect the User's ability to create an account, log in, or use the core features of the Service. The Service Provider does not bundle non-essential consent into account sign-up.
4. The User may change or withdraw any non-essential consent at any time in the following ways:

a) Use the "Cookie settings" link in the footer or a persistent cookie-preferences button to re-open the preference centre;

b) Toggle any category off; withdrawal takes effect going forward and is as easy as granting consent;

c) Block or delete cookies in the browser settings; this may affect functional features and, for strictly necessary cookies, may break the Service;

d) Use Google's browser opt-out tool for Google Analytics 4, or adjust advertising settings in the Meta account for Meta.

1. Withdrawing consent stops future tracking; withdrawal does not undo tracking that already lawfully happened before withdrawal. When the User withdraws, the Service Provider stops the relevant non-essential processing and, where applicable, signals the change to the affected third party.
2. The Service Provider keeps records of consent choices, for example in the consent cookie or its logs, so it can honour and demonstrate those choices.
3. Consent is not permanent. The Service Provider re-requests consent through the banner periodically, and sooner whenever there is a material change to cookie use, under Article 15 of this Policy.

## Chapter V. THIRD PARTIES AND CROSS-BORDER DATA TRANSFERS

**Article 13. Third parties who may receive data**

1. The third parties who may receive data through the Service are listed in the table below:

1. At default configuration, the Service Provider treats Google and Meta as independent controllers and third-party recipients, not as the Service Provider's processors. Where the Service Provider later signs a data-processing agreement that makes either of them the Service Provider's processor, the Service Provider will update Articles 10 and 11 and the table in clause 1 of this Article together.
2. Google and Meta process data under their own policies as independent controllers; the User is encouraged to review Google's privacy and Google Analytics 4 data-use terms and Meta's data policy and business-tools terms.

**Article 14. Cross-border data transfers**

1. Enabling the Google analytics category or the Meta advertising category means the User's personal data is transferred to recipients outside the territory of Vietnam, for example to the United States and other countries where Google and Meta operate. Under Decree No. 13/2023/ND-CP, this is a cross-border transfer of personal data that carries specific obligations.
2. For these transfers, the Service Provider relies on the User's specific, informed opt-in consent for the non-essential categories, including being told the recipients and that the data leaves the territory of Vietnam, together with the providers' contractual and technical safeguards.
3. Because the Service actually transfers personal data abroad to Google and Meta, the Service Provider prepares and maintains a dossier assessing the impact of transferring personal data abroad and a Personal Data Processing Impact Assessment under Decree No. 13/2023/ND-CP, and files them with the Ministry of Public Security, the Department of Cyber Security and Hi-Tech Crime Prevention, as required; preparation and filing are completed before the relevant cross-border transfer is enabled. This is an obligation, not an optional step.
4. For visitors in the European Union and the European Economic Area, transfers from that area to third countries are additionally subject to Chapter V of the General Data Protection Regulation, for example adequacy decisions or standard contractual clauses maintained by Google and Meta.

## Chapter VII. RIGHTS OF THE DATA SUBJECT, RETENTION AND SECURITY

**Article 16. Rights of the Data Subject**

1. Under Decree No. 13/2023/ND-CP, the Data Subject has rights, including: the right to be informed, including which third parties process the Data Subject's data and where; the right to access data; the right to correct data; the right to delete data; the right to restrict processing; the right to object to processing; the right to withdraw consent at any time; the right to request data portability where applicable; and the right to lodge a complaint with the competent State authority, the Ministry of Public Security, the Department of Cyber Security and Hi-Tech Crime Prevention.
2. For visitors in the European Union and the European Economic Area, the Data Subject additionally has the rights of access, rectification, erasure, restriction, portability, objection and withdrawal of consent, and the right to lodge a complaint with the local supervisory authority under the General Data Protection Regulation. For these visitors, the lawful basis is identified per purpose, namely: consent for all non-essential cookies of Category 2 to Category 4; and, for essential cookies of Category 1, contract performance, the Service Provider's legitimate interests in a secure and functioning site, and legal obligations. Legitimate interests is a basis under the General Data Protection Regulation and is used here only for visitors in the European Union and the European Economic Area; it is not relied upon under Decree No. 13/2023/ND-CP.
3. To exercise the rights, the Data Subject sends a request to [contact@donquaan.com](mailto:contact@donquaan.com). The Service Provider may need to verify the Data Subject's identity and will respond within the time limit required by Decree No. 13/2023/ND-CP and, for visitors in the European Union and the European Economic Area, within the time limits of the General Data Protection Regulation.

**Article 17. Data retention and security**

1. Cookie-related data is retained only as long as needed for the purpose it was collected for or for the cookie's stated lifetime under Article 15 of this Policy, after which it expires or is deleted or aggregated. Consent records are kept as needed to evidence the Data Subject's choices.
2. The Service Provider and the processors Cloudflare and Supabase apply reasonable technical and organisational measures to protect data, consistent with the Law on Cyber Information Security 2015 and Decree No. 13/2023/ND-CP. No method of transmission or storage is perfectly secure; the Service Provider cannot guarantee absolute security.
3. Because the Service processes personal data at scale and transfers it abroad to Google and Meta, the Service Provider prepares and maintains a Personal Data Processing Impact Assessment and a dossier assessing the transfer of personal data abroad under Decree No. 13/2023/ND-CP, and complies with the related filing and notification duties to the Ministry of Public Security, the Department of Cyber Security and Hi-Tech Crime Prevention. This is an obligation, not a contingency.
4. The Service Provider provides the cookie-management and consent tools on an as-is basis. Third-party browser extensions, ad-blockers, do-not-track signals and global privacy control signals, and device-level controls are outside the Service Provider's control; where technically feasible, the Service Provider honours recognised signals, but cannot guarantee the behaviour of tools it does not operate. Any overall limitation of liability for the Service is set out in the Terms of Service.

## Chapter VIII. CHILDREN

**Article 18. Protection of children's data**

1. The Service has a minimum age of 13 years, with additional protective measures for anyone under 16 years of age, under the Age, Eligibility and Cooperation Terms. The Service Provider does not knowingly direct cookies at, or collect personal data from, anyone under 13 years of age.
2. The Service Provider does not operate an intrusive age-verification gate beyond stating this minimum-age requirement. Stating a minimum age is not treated as a substitute for the Service Provider's legal obligations.
3. Under Decree No. 13/2023/ND-CP, processing the personal data of a child under 16 years of age generally requires the consent of a parent or legal guardian, with additional protective measures for children's data. If the Service Provider becomes aware that it has collected personal data from anyone under 16 years of age, or from a minor who should not be using the Service, the Service Provider stops processing that data and deletes it promptly.

## Chapter IX. GOVERNING LAW, DISPUTE RESOLUTION AND IMPLEMENTATION PROVISIONS

**Article 19. Governing law and dispute resolution**

1. This Policy is governed by the law of the Socialist Republic of Vietnam.
2. Disputes arising out of or relating to this Policy are submitted to the competent Court of Vietnam for resolution. Choosing the courts of Vietnam does not take away the rights the User has under laws that apply to the User regardless. For users in the European Union and the European Economic Area, certain mandatory consumer-protection and data-protection rights cannot be waived by a choice-of-law or choice-of-court clause, and this Article does not attempt to do so.
3. Where the User is a consumer, the User's rights under the Law on Protection of Consumer Rights 2023 are respected and are not unlawfully restricted by this Policy.
4. This Policy does not itself set liability limits; any limitation of liability applicable to the User's use of the Service is governed by the Terms of Service.

**Article 20. Contact**

For any question, request or complaint about cookies or this Policy, including exercising the Data Subject's rights or managing consent, the User contacts the Service Provider:

4. No company, registration number, or corporate data protection officer exists; the Service Provider is a single individual. A representative in the European Union and the European Economic Area under Article 27 of the General Data Protection Regulation is not currently appointed; one will be designated if and when the General Data Protection Regulation so requires.

**Article 21. Amendment and version management**

1. The Service Provider may update this Policy to reflect new cookies, new providers, new legal requirements, or new features of the Service. When it does, the Service Provider updates the version number and the effective date at the top of the document; a material change increases the major version number.
2. For material changes, for example adding a new tracking provider, a new non-essential category, or a new cross-border destination, the Service Provider gives reasonable, prominent notice and, where the change affects non-essential processing, re-obtains the User's consent through the cookie banner before that processing begins.
3. The Service Provider keeps superseded versions of this Policy for reference; the User may request a copy through [contact@donquaan.com](mailto:contact@donquaan.com).

**Article 22. Effect and related documents**

1. This Policy takes effect from 08/07/2026.
2. This Policy is an integral part of the system of documents governing the Service and is to be read together with the Terms of Service, the Privacy Policy and other related documents published at donquaan.com/rules-and-policies.
3. Where a provision of this Policy is determined to be invalid or unenforceable, the remaining provisions remain in full effect.
