GENERAL PROVISIONS **Article 1. Scope and subjects of application** 1. This Acceptable Use Policy (the "Policy") sets out the content and conduct that are permitted and prohibited when accessing or using the website donquaan.com together with all subdomains, pages, comment sections, accounts and interactive features (collectively, the "Service"). 2. This Policy applies to every User who accesses or uses the Service, whether or not an account is created. 3. This Policy is an integral part of the Terms of Service and is to be read together with the Terms of Service, the Privacy Policy and the Cookie Policy. **Article 2. Definitions** In this Policy, the following terms are understood as follows: 1. "Service Provider" means Mr. Nguyễn Vũ Đông Quân (known as "DonQuaan"), a natural person having full civil legal capacity and full capacity for civil acts under the Civil Code 2015, being the owner and operator of the Service. 2. "User" means an individual who accesses or uses the Service. 3. "User Content" means any data, text, image, link, comment or other material that a User uploads, submits or transmits through the Service. 4. "Child" means a person under 16 years of age, pursuant to Article 1 of the Law on Children 2016. **Article 3. Status of the Service Provider** 1. The Service is a personal website operated by the Service Provider in an individual capacity; it is not the activity of an organisation or juridical person. 2. All contact and reports relating to this Policy are made through the email address: [contact@donquaan.com](mailto:contact@donquaan.com). --- ## Chapter II. CONDITIONS AND AGE **Article 4. Age conditions** 1. The minimum age to create an account, post User Content or submit personal data through interactive features is 13 years. Persons under 13 are not permitted to register. 2. For Users under 16 years of age, additional protective measures and the requirement of parental or guardian consent apply under Article 20 of Decree No. 13/2023/ND-CP and the Law on Children 2016, as detailed in the Age, Eligibility and Cooperation Terms. **Article 5. Handling of under-age accounts** 1. The Service Provider relies in the first instance on the User's self-declaration of age and does not operate intrusive age-verification technology. 2. Where the Service Provider learns, or has a reasonable basis to believe, that an account holder is under 13, or that a User under 16 lacks the required parental or guardian consent, the Service Provider restricts or removes the account and deletes the associated personal data, except records the law requires to be retained, within a reasonable time. 3. Anyone may report a suspected under-age account under Article 13 of this Policy. --- ## Chapter III. PRINCIPLES OF USE **Article 6. General principles** 1. The User uses the Service for its proper purpose, respects others, is honest, and complies with the law of Vietnam and this Policy. 2. The User is responsible for the User Content the User posts and for activity under the User's account. --- ## Chapter IV. PROHIBITED CONDUCT **Article 7. Child safety — zero tolerance** Any conduct that exploits, abuses or endangers children is strictly and absolutely prohibited, with zero tolerance, including creating, uploading, transmitting, sharing or soliciting child sexual abuse material in any form, whether real, drawn, computer-generated or generated by artificial intelligence, and any grooming or approach to a child for the purpose of abuse. The Service Provider acts immediately and cooperates with the competent authorities as required by law. **Article 8. Harassment, hate and threats** The User must not: 1. Harass, bully, threaten, stalk or pester others; 2. Incite hatred or discrimination targeting protected characteristics; 3. Threaten violence, or glorify or promote violence; 4. Unlawfully disclose the personal information of others; 5. Promote or instruct self-harm. **Article 9. Unlawful content and infringement of rights** The User must not: 1. Upload or transmit content that violates the law of Vietnam, including content that harms national security, is obscene, defames or offends the honour, dignity or reputation of others, or discloses State secrets or information protected by law; 2. Infringe intellectual property rights or other lawful rights of third parties, in breach of the Law on Intellectual Property 2005; 3. Spread false information that causes public alarm or harms the lawful rights and interests of organisations or individuals. **Article 10. System security, spam and fraud** The User must not: 1. Distribute malware; carry out attacks, scanning, exploitation of vulnerabilities, or unauthorised interference with the Service or related systems, in breach of the Law on Cybersecurity 2018; 2. Use automated means to access, copy, collect or extract the Service's data without authorisation; 3. Distribute spam, impersonate, phish, or engage in fraudulent conduct. **Article 11. Misuse of others' personal data** The User must not collect, store, disclose or otherwise process the personal data of others through the Service without a lawful basis and, where required, their consent, in breach of Decree No. 13/2023/ND-CP. --- ## Chapter V. ENFORCEMENT AND HANDLING OF VIOLATIONS **Article 12. Graduated handling measures** 1. Upon detecting a violation, the Service Provider applies a measure proportionate to the nature, seriousness, frequency and impact of the violation, together with the User's history, on a graduated scale: warning; restriction of features; removal of content; suspension of the account; termination of the account. 2. For serious violations, in particular child-safety violations under Article 7, credible threats of violence, or attacks on system security, the Service Provider may skip the steps and immediately apply removal and termination. **Article 13. Reporting violations** Anyone may report infringing content or conduct to [contact@donquaan.com](mailto:contact@donquaan.com). For an urgent safety matter, in particular child safety, the email subject line should read "URGENT — SAFETY" so it can be prioritised. **Article 14. Appeal** A User subject to a restriction, content removal, suspension or termination of an account may submit a written appeal to [contact@donquaan.com](mailto:contact@donquaan.com), stating the reasons and providing supporting materials; the Service Provider reviews the matter objectively and notifies the outcome within a reasonable time. --- ## Chapter VI. IMPLEMENTATION PROVISIONS **Article 15. Relationship with other documents** This Policy supplements the Terms of Service; in the event of a conflict as to permitted content and conduct, this Policy prevails for the matters it governs, while limitation of liability and dispute resolution are governed by the Terms of Service. **Article 16. Amendment and version management** 1. The Service Provider may amend this Policy; the version and effective date are updated at the top of the document. 2.
