# Annex on Donations

# Annex on Server Donations

This document is the Annex on Server Donations, cite code ANX-3, issued within the DonQuaan Community Legal Framework and constituting an annex to TOS §6. It governs the receipt, refund and handling of voluntary donations made to the Server, and shall be binding upon the Server and upon every Member who makes a donation as from the effective date posted in the document control block of this page. ### Article 1. Receipt of voluntary donations

1.1. The Server receives voluntary donations under the content creator model, that is to say, it receives support from the community for its creative and operational activities.

1.2. A donation is a voluntary act. A donation shall not be a condition for joining the Server, for maintaining Member status, or for using any feature of the Server.

1.3. The official donation receiving point shall exist in one publicly posted place only, comprising this page and the [official announcement channel](https://discord.com/channels/1342729473245577267/1529782982016110642). Any solicitation of donations in the name of the Server made in a place that is not officially posted, including direct messages of unverified origin, impersonation of the staff, and QR codes of unknown origin, shall be deemed impersonation or fraud and shall have no binding effect on the Server. A Member who detects such conduct must report it through the [Single-Window Channel](https://discord.com/channels/1342729473245577267/1343099398720065559). Verification of official channels shall be carried out in accordance with the [annex on identity verification](https://donquaan.com/discord/verify).

### Article 2. Donations in real currency

2.1. The Server shall accept donations in real currency only from persons of legal age and having civil act capacity under Vietnamese law, and only from lawful funds within the donor's right of disposal.

2.2. Implementing the Terms of Service §25.4(b): where the Server determines that a donor is under legal age or that the source of funds is unlawful, the Server shall refund that donation and shall suspend the receipt of donations from that person until such person satisfies the conditions set out in Article 2.1.

2.3. A donation in real currency carries no reciprocal commitment of any kind. A donation is not exchanged for goods, is not exchanged for services, is not exchanged for privileges, and creates no obligation for the Server to perform any particular work. Any description of the intended use of funds, if given, is indicative only and shall not constitute a commitment or a contract.

### Article 3. Virtual items and in-platform currency

3.1. With respect to virtual items, virtual gifts or in-platform currency that have no legal value and are not convertible into real currency, the Server may receive them including from persons under legal age, as the law does not prohibit the giving of such items.

3.2. A person who gives virtual items or in-platform currency may request a refund by opening a support ticket through the [Single-Window Channel](https://discord.com/channels/1342729473245577267/1343099398720065559). The Server shall refund 100% thereof, subject to no time limit and irrespective of the age of the giver, under the Terms of Service §25.4(c). Where the item has been consumed or has expired, the Server shall refund an equivalent quantity of virtual items or in-platform currency, so that the 100% refund is always secured in value.

### Article 4. Tax obligations and transparency

4.1. The Server shall discharge its tax obligations in respect of donations in real currency under Vietnamese law.

4.2. The mechanism for recording and reconciling donations shall follow OWN §43.2.

### Article 5. Final provisions

5.1. Order of precedence: this document is an annex to TOS §6. In the event of a conflict between this document and the TOS, the TOS shall prevail to the extent of the conflict.

5.2. Amendment and effect: every amendment to this document shall be published at the [legal framework page](https://donquaan.com/discord) and notified through the [official announcement channel](https://discord.com/channels/1342729473245577267/1529782982016110642), and shall take effect as from the effective date stated in the document control block of the amended version.

5.3. Governing law: this document shall be governed by Vietnamese law.

5.4. Severability: if any provision of this document is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

5.5. The anti-impersonation principle and the No-Money-Request principle are set out in TOS §6.
